Criminal offences under penal code

This post is about alleged criminal offences under the penal code committed by Malaysian Immigration officers against me.

After I have won the legal challenges against the Malaysian Immigration authorities on 4th May 2021 on their unlawful, illegal and unconstitutional detention, it is now a fact that there is criminal acts committed against me.

As a victim of criminal acts, I then proceeded to file police reports against certain named Malaysian Immigration officers on their alleged criminal acts. These reports were filed on 8th December 2021.

Two police reports were on two separate unlawful, illegal and unconstitutional detentions and two police reports were on perjury and presenting “tampered” and “manufactured” evidence.

On 30th September 2022, I filed an additional police report based on KL high Court sealed Order dated 12- September 2022 for my second legal challenge.

Instructions given by Malaysia High Commission on making the police reports

These police reports were filed at a police station in Singapore following the instructions given by the Malaysian High Commission in Singapore. Why I have to seek instructions from the Malaysian High Commission is because the Malaysian Immigration authorities had put me on a lifetime blacklist, making it impossible to file police reports at any police station in Malaysia.

Correspondences between my Malaysian lawyer and PDRM

As I am not able to be in Malaysia physically, all my Malaysian matters are conducted by my Malaysian lawyer acting on my behalf. Hence my Malaysian lawyer wrote to PDRM on 21st March 2021 to follow up on my behalf with PDRM.

Around that time, I received an email reply dated 24th March 2022 from the Malaysia High Commission to inform me that Interpol Bukit Aman is taking necessary action.

However, Interpol Bukit Aman replied on 28th April 2022 the following: “We have referred your matter Legal & Prosecution Division, Criminal Investigation Department, Royal Malaysia Police and they notify us to advice that since you are acting for your client Mr. Wong Chun Khuen who is in Singapore and the incident reported by him took place in Johor, Malaysia kindly lodge any official police report in Malaysia on behalf of your client by providing all supporting documents regarding his complaint for our police to take further necessary action.”

However, it was not possible for me to lodge police reports in Malaysia as the Malaysian Immigration authorities has put me on the Immigration blacklist for lifetime.

With the reason that I have to lodge these official police report in Malaysia, Interpol Bukit Aman requested my Malaysian lawyer to lodge police reports on my behalf. My lawyer informed that making police reports is not what lawyer can do on behalf of client. He requested Interpol Bukit Aman to provide the mechanism for me to make my complaint from Singapore.

The only way for me to make my complaints in Malaysia is to be given an Immigration special pass to enter Malaysia for me to make my complaint officially in Malaysia as per Malaysian Police protocol. Hence, we would request the court to make this ruling for an Immigration pass so that I can make these police reports in Malaysia.

KL High Court Order is proof of criminal offences

On the 12th September 2022, the KL High Court granted me a Court Order declaring that the period of detention from 27th March 2018 to 3rd April 2018 (eight days) was unlawful, illegal and unconstitutional. With this new evidence of a crime committed against me, I proceeded to make an additional police report to include the new information. Following, I emailed to PDRM on 13th October 2022 for their necessary action based on all the additional evidence and new information.

PDRM ignored and took no action on police reports

After my email to PDRM dated 13th October 2022 did not received a reply nor a response, I filed a complaint to EAIC on this criminal offence committed by Malaysian Immigration authorities.

This complaint is related to the 2nd part unlawful, illegal and unconstitutional detention and was filed on 24th October 2022.

There was ample evidence that a Malaysian Immigration officer had committed an offence under the Penal Code section 220 against me and with my filed police report, justice must be served by taking prosecutive action on the perpetrator of the crime. However, even the EAIC despite being a high level Malaysian Government commission with charter on maintaining integrity of Malaysian public servants/officers refused to open an investigation.

Court of Appeal Malaysia Order is proof of criminal action

On the 31st October 2022, the Appeal Court of three judges re-affirmed the KL High Court Order on the 1st part detention from 13th March 2018 to 26th March 2018 was unlawful, illegal and unconstitutional.

With this new evidence and confirmation of a wrongful confinement under the Penal Code Section 344, I proceeded to emailed PDRM on 3rd November 2022 for their necessary enforcement action.
